In a recent ruling, the Supreme Court emphasized the importance of equality in household responsibilities for married couples. The bench, comprising of Justices Vikram Nath and Sandeep Mehta, was hearing a petition brought forth by a man who was challenging a decision made by the Karnataka High Court. The man had filed for divorce on the grounds of cruelty, but the high court had dismissed his plea, citing lack of evidence.
During the hearing, the man's lawyer argued that attempts at mediation between the couple had failed and that they had been separated since 2019, just two years after their marriage in May 2017. "I want a divorce," the lawyer stated, "The trial court granted a divorce on the ground of cruelty." When asked by the bench what the alleged cruelty was, the lawyer explained that the woman had been neglecting her duties and not cooking for the household. In response, Justice Nath wisely pointed out that in today's times, both partners should equally participate in household tasks such as cooking, cleaning, and washing.
He further added that the high court was correct in their decision as this could not be considered as a valid reason for cruelty. Justice Mehta also chimed in, reminding the man that he was not marrying a maid, but a life partner. The court was informed that both parties were working in a government school.
In light of this, the bench requested for both parties to be present physically for the next hearing. "We would like to speak to them," the bench stated. The matter was then adjourned until April 27, with the instruction for both parties to be present.
