The Supreme Court of India announced on Tuesday that they would not be considering the bail requests of Manish Sisodia, a prominent leader of the Aam Aadmi Party (AAP). These pleas were related to the ongoing investigations by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) into the alleged liquor policy scam in Delhi.
However, the court did mention that Sisodia could refile his petitions for bail once the ED and CBI have completed their final prosecution complaint and charge sheet, respectively. It is worth noting that a prosecution complaint, in the case of ED, is equivalent to a charge sheet.
During the hearing, Solicitor General Tushar Mehta, representing the ED and CBI, stated that the agencies would be filing their final prosecution complaint and charge sheet by July 3. On the other hand, senior advocate Abhishek Singhvi, appearing for Sisodia, argued for his bail, mentioning that the trial for these cases has not yet begun despite the politician being in custody for 15 months. He also added that the trial is unlikely to start anytime soon as the investigations are still ongoing.
Sisodia had approached the apex court to challenge the Delhi High Court's decision on May 21, which rejected his bail pleas in the cases being investigated by the two central agencies. The high court had dismissed his bail applications, citing the grave misuse of power and breach of public trust by Sisodia.
The former deputy chief minister of Delhi, Sisodia, had also challenged the trial court's order from April 30, where his bail pleas were rejected in the cases related to the alleged irregularities in the development and execution of the now-scrapped Delhi excise policy for 2021-22.
Sisodia was arrested by the CBI on February 26, 2023, for his alleged involvement in the liquor policy case. He was later arrested by the ED on March 9, 2023, in connection with the money laundering case, which stemmed from the CBI's FIR. Following these events, Sisodia resigned from his position in the Delhi cabinet on February 28, 2023.
