Bibhav Kumar, the accused in the Maliwal assault case, has been presented in court and the police has requested a 7-day custody.
The city of New Delhi was buzzing with news as Delhi's Chief Minister, Arvind Kejriwal's assistant, Bibhav Kumar, was brought before a magisterial court on Saturday. This was in connection with the alleged assault on Swati Maliwal, a member of the Aam Aadmi Party (AAP) in the Rajya Sabha. The Delhi Police had arrested Kumar earlier that day and his anticipatory bail plea was rendered "infructuous" by a court in Delhi.

Kumar was then presented before Metropolitan Magistrate Gaurav Goyal. The police, through their counsel, requested for a seven-day custody of Kumar to question him about the assault case. It is believed that Kumar, who is the personal assistant of Chief Minister Kejriwal, had assaulted Maliwal at the CM's house on May 13. The police argued that Kumar's custody was necessary in order to understand the reason behind the assault. They also stated that Kumar had not provided the password of his mobile phone to the investigating agency and had informed them that his phone had been formatted in Mumbai due to a malfunction.

The police further explained that before formatting a phone, the data needs to be cloned and Kumar's presence was required in Mumbai to retrieve the data. They also needed his assistance in opening the phone with the help of an expert. In response to this, Kumar's lawyer, Rajiv Mohan, countered their arguments by stating that there was no record of Maliwal's visit to the CM's residence before May 13. Mohan also questioned why the FIR was registered on May 16, three days after the alleged assault, at the Civil Lines police station.

Mohan also claimed that Maliwal had visited the CM's residence without an appointment and that the Delhi Police was distorting facts. He further stated that Maliwal did not seek any medical aid after calling the emergency helpline number nor did the station house officer prepare any medical sheet after meeting her. Mohan also alleged that Maliwal was politicizing the issue of her injuries and was making statements to the media. He argued that Kumar's mobile phone was not needed for the investigation as Maliwal had not mentioned any threats made to her through phone or WhatsApp.

The entire incident, which was reported by PTI, has caused quite a stir in the city. As the case unfolds, the truth behind the alleged assault will soon come to light.
