The Bombay High Court recently quashed an FIR against a city doctor, Dr Heena Shaikh, who was accused by her sister-in-law, Rumana, of using her late husband’s SIM card and selling his movable property without consent. Dr Shaikh's advocate, Vinay Nair, argued that even if the prosecution case was true, no offence could be inferred against her. However, Rumana's advocate SA Shaikh and additional public prosecutor KV Saste opposed the plea, claiming that an offence had occurred.
The court ultimately noted that the FIR did not disclose any offence against Dr Shaikh and that continuing the criminal proceedings against her would be an abuse of the process. As a result, the court quashed the FIR on August 17.
