Gibson continues fight for justice after being shot by FedEx security guard.
D'Monterrio Gibson, a former Federal Express delivery driver, is suing his former employer as well as two men who allegedly shot at him while he was on his delivery route. His lawyer, Carlos Moore, is seeking $5 million in damages on behalf of Gibson, who has allegedly suffered depression, stress, anxiety, loss of sleep, and emotional pain and suffering.

The incident occurred in January 2022 when Gibson was making a delivery near the residences of Gregory and Brandon Case, a father-son duo. Gibson claims that the pair chased and fired at him, leading to accusations of racism in Brookhaven.

An earlier lawsuit against the Cases filed by Moore was dismissed by U.S. District Judge Daniel Jordan, who wrote that Gibson's claims were not viable. A mistrial was declared in the former case due to mishandling of the police investigation. The grand jury criticized the Brookhaven Police Department for their lack of urgency and for blaming the witnesses.

Moore compared the Cases' alleged attempt on Gibson's life to the 2020 murder of Ahmaud Arbery. “It seems to be a copycat duo copying off the Ahmaud Arbery case...They saw this man was a Black man, and they just hauled off and shot at him multiple times, at least the younger son did. The older guy tried to entrap him. They were working concertedly to try to entrap and kill this man. I mean, they shot at him several times. It’s amazing that he survived,” Moore said.

Gibson expressed his frustration with the police investigation process, telling the Free Press in February, “They gave them too much time to hide evidence and to do other things, and they should have been on their case. They were too focused on worrying about what people thought about Brookhaven.”

In response to the incident, FedEx initially placed Gibson on unpaid leave, but after a national outcry, they paid his salary and therapy costs. Moore has also called on the FBI and the Department of Justice to investigate the crime as a hate crime. “We believe that this was a racially motivated crime. They clearly could see when he stepped out of the van that he was a Black man, and they chased this Black man who was in a white neighborhood because allegedly he was suspicious while he was doing this job with a clear FedEx uniform on. If that’s not racially motivated, I don’t know what is,” Moore said.

Gregory and Brandon Case face charges of attempted first-degree murder, conspiracy, and shooting into the vehicle operated by Gibson. A new trial is expected to be set for them, though it could take months for a date to be officially set. Gibson told WLBT-TV that the process has taken too long. “It was an extremely long process to get this far into the case,” he said. “I feel like most of the time, I was treated like a suspect rather than a victim.”
