In a recent development, the NSW Environment Protection Authority has taken action against multiple parties regarding the use of asbestos-tainted mulch in Sydney. This comes after a thorough investigation, which the EPA has deemed as the largest in its history. The investigation was prompted by the discovery of bonded asbestos in mulch at Rozelle Parklands earlier this year.
After inspecting 300 sites, the EPA found that 79 of them had used the tainted mulch. This prompted the authorities to take swift action, resulting in the cleanup of all 79 sites. The EPA has not held back in its pursuit of justice, as they have laid a total of 102 charges as a result of their investigation.
One of the companies facing charges is VE Resource Recovery Pty Ltd, who stands accused of breaching their environment protection licence by not competently carrying out their resource recovery activities. In addition, the director of the company, Arnold Vitocco, has also been charged with executive liability in relation to the alleged breach.
Two other entities, Freescale Trading Pty Ltd and Runkorp Pty Ltd, trading as Greenlife Resource Recovery Facility, have also been charged with 50 offences each. These include breaching a resource recovery order, re-using asbestos waste, and carrying out various activities without the necessary EPA-issued licence.
The alleged offences are said to have occurred at 26 different sites, including Rozelle Parklands. The first directions hearing for these cases is scheduled for Friday, February 7, 2025.
