The Karnataka High Court has issued a major ruling in which it has refused to grant bail to a woman accused of stabbing her husband to death. The bench headed by Justice Mohammad Nawaz said that being a woman cannot be considered as a criterion for bail. The accused, Dilli Rani, had been in judicial custody since September 24, 2022, and had appealed against the order of the 63rd Additional Civil and Sessions Court which had rejected her plea.
The counsel of the accused argued that considering the fact that the accused is a woman, she should be granted bail. However, the bench dismissed this argument and maintained that because she was injured in the incident, the accused could not be considered as innocent.
The court was informed that the accused had slit her husband's throat after he questioned her affair with another man. Three witnesses have confirmed the affair between the accused and the second accused in the case. It was believed that Shankar Reddy was killed as he was a roadblock to the illegal affair. The police have recovered earrings, mangalya chain and night wear of the accused which has blood stains on it. The minor son of the couple testified that he saw his father in a pool of blood after waking up.
The court noted that the crime was of serious nature and bail could not be granted just because the accused was a woman. The couple had two children and Shankar Reddy had shifted his family to Bengaluru for the sake of their education. It was revealed that the accused and her lover had hatched a conspiracy to kill Shankar Reddy, and on February 24, 2022, the accused slit his throat while he was asleep. The Yeshwanthpur police investigated the case and arrested the accused and her lover.
The Karnataka High Court thus refused to grant bail to the accused, Dilli Rani, and maintained that being a woman was not enough reason to grant bail in this case.
