He had been in jail since his arrest on May 25 for allegedly damaging an EVM (electronic voting machine) during voting. The bail has been granted for three days, from June 9 to 11, and he has been asked to surrender before the court on June 12.

According to Jagdev's lawyer, Prabhat Dash, they had requested for a month-long bail in order for Jagdev to attend his swearing-in ceremony on June 10 and also to mourn the death of his nephew. However, the Khurda district court has only granted three days of bail. Dash stated that they will be moving to the Orissa High Court to request an extension of the bail period and also for regular bail.

Jagdev's arrest took place on May 26, after he allegedly damaged an EVM and assaulted two polling personnel at a booth in Kaunripatana village during the third phase of polls in the Begunia Assembly constituency in Khurda district. Even though he contested from Khurda, he is a registered voter of Begunia seat. He has been charged under various sections of the Representation of People's Act, as well as Sections 294, 506, and 354 of the Indian Penal Code.
