A 27-year-old man has been sentenced to 10 years imprisonment for eloping with a 14-year-old girl and sexually assaulting her on multiple occasions. The special POCSO court in Mumbai rejected the defence plea that the relationship between them was consensual, observing that the girl was not of the age to give consent.
The case registered with VB Nagar police station was reported by the victim's mother. On March 10, 2019, the girl left the house but did not return even after a long time. The police tracked her and the accused, who lived in the same locality, to the native place of the accused. They were brought back to Mumbai on May 14, 2019.
According to the victim's statement, she had been in touch with the accused for the past few months. On the day of the incident, he took her to his relative's house in an auto rickshaw and kept her there for 8 days. During this period, they had intimate relations. Later, they moved to the accused's native place in Uttar Pradesh. However, as his father refused to give them shelter, they stayed in a garden nearby. Here, the two had physical relations multiple times.
The defence argued that the victim's statement was an exaggeration but the court noted that even if it was, the accused could not take advantage of the minor's age and commit an act prohibited by law.
In a separate case, Taloja Police in Navi Mumbai arrested a man for allegedly raping a minor. The case has been booked under the Protection of Children from Sexual Offences (POCSO) Act.
