A grandmother from Melbourne is taking legal action against Yarra Trams after she suffered injuries while riding on a tram in 2021. Marina Kirby, a 70-year-old woman, was on the 109 tram when the driver suddenly hit the brakes, causing her to be thrown from her seat. As a result of the incident, Kirby sustained multiple injuries, including six broken ribs, a broken finger, a shattered kneecap and torn meniscus, and a twisted ankle.
Speaking to 9News, Kirby expressed her frustration, stating that there was no reason for the tram to come to such a sudden stop. She also shared that the accident has caused her ongoing pain and discomfort, with her left leg swelling to more than twice its size. "There's constant bleeding," Kirby revealed, highlighting the severity of her injuries.
Kirby's daughter, Rachael, also expressed concern for her mother's well-being, stating that her quality of life has significantly deteriorated since the accident. As a result, Kirby has been forced to retire, despite not wanting to do so. Seeking justice for her injuries, Kirby has decided to pursue legal action against Yarra Trams, with the support of her legal representative, Tamara Wright from Shine Lawyers.
According to Wright, Kirby was traveling on a section of the tram track that was designated as light rail, meaning there were no vehicles or pedestrians in the way. Despite this, the driver allegedly did not show any concern or offer assistance when Kirby fell to the ground. In fact, she was told to get off the tram so that it wouldn't be delayed. "I should have been taken straight to the hospital," Kirby expressed, highlighting the lack of compassion and care shown by the driver.
In addition to seeking compensation for her injuries, Kirby is also calling for Yarra Trams to implement driver compassion training to prevent similar incidents from occurring in the future. As she continues to struggle with the aftermath of the accident, Kirby hopes that her actions will bring about positive change and prevent others from experiencing the same mistreatment.
